Terms for No Contact Tracker

1. Acceptance of Terms

By downloading, accessing, or using the No Contact Tracker mobile application (“the App”), provided by Suman Sharma (“Developer,” “I,” or “me”), you agree to be bound by these Terms & Conditions (“Terms”), including the Privacy Policy. If you disagree with any part of the terms, you must not use the App.

2. Nature of the App and Disclaimer of Medical Advice

The No Contact Tracker App is NOT a Substitute for Professional Help.

  • Informational Purpose Only: The App, its features (including the AI Recovery Timeline, Freedom Date Calculator, Premium Lessons, and Panic Button resources), and all content are provided for informational, motivational, and self-help tracking purposes only.
  • No Medical/Therapeutic Advice: The App is not designed to provide diagnosis, treatment, or therapy for any medical or psychological condition. The Developer is not a licensed healthcare provider, psychologist, or therapist.
  • Professional Consultation: You acknowledge and agree that the App does not constitute professional medical, psychological, or psychiatric advice. If you are experiencing a mental health crisis, suicidal thoughts, or require professional medical advice, you must seek assistance from a qualified healthcare professional or emergency services immediately.

3. Grant of License

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on a single device, strictly in accordance with these Terms. You are not permitted to copy, modify, distribute, sell, or rent any part of the App.

4. User Data and Local Storage

  • Local Storage: As detailed in the Privacy Policy, all sensitive user data, including Daily Logs, Journal Entries, Ick Lists, and Recovery Timelines, is stored locally and securely on your device. The Developer does not access, collect, or store this personal data.
  • User Responsibility: You are solely responsible for protecting the security and integrity of the device on which the App is stored.

5. Subscription Terms and Billing (Premium Features)

  • Premium Membership: The App offers optional subscriptions (e.g., Weekly, Monthly, Annual) to unlock Premium Features (e.g., Advanced Analytics, Exclusive Lessons).
  • Billing: Subscriptions are billed directly by the App Store (Apple) or Google Play, not the Developer. All payment processing, cancellation, and refunds are subject to the respective platform’s terms and conditions.
  • RevenueCat: Subscription management is handled by a third-party service, RevenueCat. By subscribing, you agree to RevenueCat’s terms of service.

6. User Conduct and Restrictions

You agree not to misuse the App, including:

  • Using the App in any way that violates any applicable local, national, or international law.
  • Interfering with the security or integrity of the App or its underlying systems.
  • Attempting to gain unauthorized access to any part of the App.

7. Intellectual Property

The App, including all its original content, features, and functionality (including the AI Recovery Timeline methodology, Progress Charts design, and Premium Lesson text), is and will remain the exclusive property of Suman Sharma. The App is protected by copyright, trademark, and other laws of the governing jurisdiction.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the App.
  • Any conduct or content of any third party in the App.
  • Any reliance placed on the information provided by the App.

9. Termination

The Developer may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, disclaimers, and limitations of liability.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Pokhara, Nepal, without regard to its conflict of law provisions.

11. Changes to Terms

I reserve the right, at my sole discretion, to modify or replace these Terms at any time. If a revision is material, I will try to provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised terms.
